Yanukovych’s defense demands to drop state treason charges against ex-president of Ukraine

The defense of former Ukrainian president Viktor Yanukovych demanded from the Prosecutor General’s Office (GPU) and Prosecutor General Yury Lutsenko to drop charges in the state treason against its client due to their full retraction. Vitaly Serdyuk, the advocate of Yanukovych claimed this as the press service of Aver Lex reported.

‘During the filing of the own evidence by the defense and due to the refusal to personally and legally question Viktor Yanukovych, the defense opened and attached on his behalf the full text of the appeal of the President of Ukraine to Russia dated March 1, 2014, in six pages that belies the opinion imposed to the society on the deploying of the Russian troops to Crimea. The presented document belies the accusations as President of Ukraine Viktor Yanukovych appealed to Russia March 1, 2014 not with a request to deploy the troops but with the appeal to hold the bilateral consultations according to article 7 of the Agreement on friendship, cooperation and partnership between Ukraine and Russia dated May 31, 1997 and inform the international community on the official position of the president of Ukraine towards the coup d’état in Ukraine. GPU dodged to attach and publish this document’, the advocate claimed.

According to the defense, the prosecutor’s office intends to convict Yanukovych for the fulfillment of his commitments provided by the legislation.

‘If Russia appointed the consultations and agreed on the appeal to help in the restoration of the peace and order in Ukraine by the use of the military or police peacekeeping mission, this issue would be passed by the president to the Verkhovna Rada of Ukraine according to the Constitution. However, such answer was not received’, Serdyuk noted.

‘Taking into account the set out, guided by article 340 of the Criminal Proceeding Code of Ukraine, the demand to Prosecutor General Yury Lutsenko to drop all charges against Viktor Yanukovych and apologize before the citizens of Ukraine for the intentional misrepresentation of them by the statements on his state treason was filed on April 03, 2018’, the advocate said.

On March 27, the break in the court hearing on the case of the state treason of Yanukovych was announced until April 4 due to the absence of the lawyers as they made business trips to Germany, Russia and Simferopol.
