The parliament of Ukraine plans to introduce a new article in the Criminal Code on “Illicit enrichment.” It will provide for 5-10 years of imprisonment if there is evidence of the unlawful enrichment of an official or a high-ranking official for an amount that exceeds 576,144 dollars.
If a smaller amount is recognized as received illicitly, the assets could be confiscated.
It is about the assets acquired by a senior official, or at their expense, or on their instruction.
The fact of illicit enrichment must be proved in court.
It is planned to establish in the Civil Code of Ukraine that recognition of assets as unjustified is one of the grounds for termination of ownership with their further exaction to the state budget.
Such cases will be considered in the Supreme Anti-Corruption Court (collegially, by three judges), and the appeal will be heard in the Appeals Chamber of the Supreme Anti-Corruption Court.
