The majority of changes will start to work since January 1, 2018

The Verkhovna Rada of Ukraine adopted the draft law #6327 in the second hearing and as a whole that implements the first stage of the medical reform. 240 MPs supported the document. 112 Ukraine broadcasts the Verkhovna Rada session.

The draft law was significantly changed during the improvement for the second hearing.

1. Any ‘half-paid medicine’

The state will pay from the state budget for the medical service, products and medicaments for the preventive measures, diagnosis, treatment and rehabilitation relative to the diseases, traumas, intoxication, pathological state and relative to the pregnancy and childbirth.

The state will pay not only the emergency, primary and palliative medical services but also the secondary, tertiary medical services, medical rehabilitation, medical service for the children under 16-s and the service relative to the pregnancy and childbirth.

The program of the medical guarantees is approved by the parliament within the law on State Budget for the certain year and it should be equal to at least 5% of the GDP.  

The state and municipal medical centers will be able to provide the commercial service but in the amount of maximally 20% from all provided services and only at the end of 2024.

The state will create the list of the programs of the public health, measures against epidemics, holding of the medical and social expertise of the activity connected with the holding of the medico-legal and psychiatric-legal expertise that will be also financed by the state.

2. Patients got more liabilities, doctor’s wage bound to average wage in Ukraine

A patient should undergo the preventive medical examinations in the order established by the Ministry of Healthcare, comply with the instructions of the doctor and observe the rules of the inner order of the medical center.

At the same time, a patient has a right to choose a doctor. If it is impossible then the person can apply for the information to the Ministry that implements the state policy in the sphere of the state financial guarantees of the medical treatment of the population.

The draft law provides that the wage of the doctor will equal to at least 250% from the average wage in Ukraine as at July 2016. This year the wage is 287.4 dollars so the next year the wage should be 696 dollars.

3. Changes towards body that will manage state funds and control of its work

The article that describes the creation of the so-called ‘authorized body’ is removed from the improved variant of the law. This central executive body should implement the state policy in the sphere of state financial guarantees of the medical treatment of the population. They kept the functions of the body and added the liability to provide the work of the electronic system of the healthcare.

‘The Committee on Healthcare amended the document on a body that should be created and the draft law provides that it is just the authorized body of central executive authority between the first and the second hearings.  These authorities can be provided to the Ministry of Healthcare or Finance Ministry of Economy Ministry. Only the Ukrainian government should define which body should do this’, Deputy Chairman of Committee on Healthcare Iryna Sysoenko explained.

According to her, they canceled the special status of the mentioned body.

The Patient Control Council was renamed into Public Control Council. They added that it will be created on the basis of the open competition and it will consist of 15 people who will be reelected every two years.

4. The reform starts in 2018

The draft law will come into force in a month after its publishing and it will start to work step by step since January 1, 2018.

However, the state will begin to pay for the medical service on the program of the medical guaranteed only since August 1, 2018.

It is planned to implement the state guaranteed for all kinds of the medical services in 2018-2019 and the whole complex should start to work since January 1, 2020.

The reimbursement will be held according to the procedure fixed by the government until December 31, 2019.
