Draft Law of Ukraine "On the Constitutional Court of Ukraine" was supported by the Venice Commission at a meeting on December 9. It was reported by the Presidential Administration's press service.
In conclusion, the Venice Commission stated that "the draft law, implementing changes to the Constitution, is a significant step forward in the implementation of European standards in the constitutional justice.”
"The Commission welcomes the competitive selection of judges, taking the oath by the judges immediately before the Constitutional Court, the establishment of time limits for the selection and appointment of judges, the release of judges directly by the Constitutional Court, the exclusion of rules on exemption of a judge “for violation of the oath”, "the introduction of the institute of the constitutional complaint", - the Commission decision says.
The bill was submitted to the Verkhovna Rada of Ukraine to implement the amendments to the Constitution in terms of justice, which entered into force on September 30, 2016. The draft introduces the regulations on the organization and operation of the Constitutional Court, the status of the Constitutional Court judges, sets out rules regarding grounds and procedures of accessing court, procedure of reviewing cases and executing court decisions.
