The law adds a sanction of community services with the allocation of payment for such services to the victim, and proposes to bring to justice military servicemen for this crime on general grounds, not on the basis of a disciplinary statute. It also allows to hear the case in court without offender’s presence, if the latter was notified in due procedure.
The document states that domestic physical, psychological or economic violence that did not cause bodily injuries such as threats, insults or harassment, deprivation of housing, food, clothing, other property or funds to which the victim is entitled by law, etc. entail the imposition of a fine of $6 to $12 or community service for a period of 30 to 40 hours, or a period of 120 to 240 hours, or administrative arrest for up to ten days. Such punishment will be also imposed in case of non-compliance with the urgent restraining order by the person against whom it was issued, or failure to notify the authorized bodies of the National Police of Ukraine of person’s temporary stay.
The same actions committed repeatedly within one year will be punished by a fine of $12 to $ 25 or community service for a period of 40 to 60 hours, or a period of 240 to 360 hours, or administrative arrest for up to 15 days.
In case of imposing an administrative penalty on the offender in the form of community service, the money for it will be transferred to the victim according to the procedure defined by Ukraine’s Cabinet of Ministers.
This law will come into force on the following day after its publication.
