The Ukrainian Parliament adopted the draft law #8487, which imposes a new principle of calculation of the rate of the excise tax for the import of cars - in the second reading and in general, as 112 Ukraine broadcasted.
The document was presented by the Head of relevant Parliamentary Committee Nina Yuzhanina.
'On the results of the consideration in the second reading, the committee in general upheld the model of the taxation adopted in the first reading and supported such offers on the differentiation of the base rate for the petrol cars with the cylinder capacity up to and more than 3,000 cubic centimeters, and for the diesel cars with the cylinder capacity up to 3,500 cubic centimeters and over this capacity. For large and expensive cars we raised the base rate from 50 to 100 Euros for petrol cars and from 75 to 150 euro for diesel cars,' she said.
Yuzhanina added that in the formula, the limit rate of a car's age was established: 'If a car is 16-, 18-, 20-year-old, then the limit rate is 15.'
A tax rate for the car equipped only with the electric engine is established in the sum of one Euro for one kilowatt per hour of the capacity of the electric accumulator of such vehicle. The tax rate for the transport, which is induced only by the electric engine, one or several units, is established in the sum of 100 Euros per item.
In transitional provisions, a grace period is provided. which is three months from the moment this law comes into force. It will be possible to clear a car, paying the half of the rate of the excise tax. Such rules concern only the cases when one person imports one car for personal use in Ukraine.
'We offered the compromise solution on the exemption for the violation of the tax norms and customs rules on the maintain of schedule and terms of the customs regimes of the temporarily import of the transit for people who fulfilled the terms of the interim arrangements of the customs clearance of the passengers cars, paying a fine in the sum of $304 for the third party to the state budget to close this transit regime and pass to the processing of the car to the import regime,' Yuzhanina added.
According to the draft law, the import and sale of bodies of the cars in Ukraine are exempted from taxation if the passengers' cars will be made from them.
The law will come into force the next day after its official publication, but not earlier than the law on fines for the non-clearance of cars comes into force.
The Cabinet of Ministers is to register an offer on sending the money from the clearance of the cars imported to Ukraine (since 2015) to the pension fund.
On July 13, 2018, Verkhovna Rada supported a bill providing for increased responsibility for breaching the rules of car import to Ukraine. The document establishes a single term for sanctions for customs rules breach, - half a year since the day of detection of the violation.
On October 22, the Supreme Court of Ukraine recognized the termless use of the cars with the EU license plates imported in the regime of transit as legal. Later, the State Fiscal Service claimed that the use of the uncustomed cars is still a violation of the law.
