Sick leave not to be paid during suspension from work due to refusal of vaccination

Sick leave benefits are not available to employees who have been suspended from work for refusing or avoiding compulsory preventive vaccination against acute respiratory disease Covid-19 as the Social Insurance Fund of Ukraine reported.

Payment is not made for those days of temporary disability that coincide with the days of suspension from duties.

"Please note that the suspension from work of employees for whom the mandatory vaccination against Covid-19 is determined, but who refused vaccination, is intended to protect their colleagues, visitors, pupils, educatee, students and others from the risk of infection and further spread of the SARS-CoV-2. Refusal of vaccinations in the absence of absolute contraindications endangers others”, the message says.

It is noted that benefits for temporary disability in this case are not funded, since, in accordance with the legislation on compulsory state social insurance, they are designed to compensate for the insured person's earnings lost during treatment. In case of suspension from work with the termination of the payment of wages of an employee who does not comply with the requirements for compulsory vaccination against Covid-19, there is no fact of loss of earnings due to illness or injury during such a period.

It should be noted that in accordance with the Resolution of the Cabinet of Ministers of Ukraine dated October 20, 2021, No. 1096, from November 8, the heads of state bodies (civil service), enterprises, institutions and organizations must ensure the suspension from work of employees, in respect of whom the compulsory preventive vaccinations against Covid are determined. -19 and who refuse or shy away from conducting them.

As we reported, a booster dose of the vaccine against the coronavirus disease will become available to residents of Ukraine after crossing the mark of 50% of vaccinated citizens.
