Prosecutor General's Office explain Tumgoev extradition to Russia

The Press Secretary of the Prosecutor General's Office Andriy Lysenko told why the Ingush Timur Tumgoev was extradited to Russia. He wrote this on his Facebook page.

According to him, at first "competent authorities of the Russian Federation" sent a request for extradition of a person for criminal prosecution for crimes under the Criminal Code of the Russian Federation, namely: training to carry out terrorist activities and participation in a terrorist organization.

Russia accuses Tumgoev of involvement in an illegal armed formation that was structurally part of the Islamic State grouping and took part in hostilities against government troops of the Syrian Arab Republic. According to him, he did not hide this fact. That is why the Prosecutor General's Office on October 13 decided to extradite Tumgoev, who appealed against the decision.

"The appeal on the decision of the Prosecutor General's Office of Ukraine for extradition was refused by the courts of the first and appellate instances. Thus, the decision of the Prosecutor General's Office on extradition came into force," Lysenko wrote.

He also said that Tumgoev applied to the migration service authorities twice (in 2016 and 2017) with a request for refugee status, but was refused.

"Thus, the person took full advantage of the right to seek protection in Ukraine, but the grounds for granting refugee status were not established," the speaker said.

The European Court of Human Rights also considered the appeal of Tumgoev to suspend the extradition procedure in the Russian Federation. The Prosecutor General's Office provided all the requested documents, after studying which, the European Court canceled all restrictive measures.

"That means, the European Court has not established any obstacles for the consideration by Ukraine of the request for the extradition of the said person," Lysenko said.

Also, the representative of the Prosecutor General's Office claims that Tumgoev did not take part in the Joint Forces Operation in Donbas.

"It should also be noted that the media is trying to create Tumgoev's “positive image” by spreading information about his participation in the Joint Forces Operation in eastern Ukraine. However, for all the time that the Prosecutor General's Office of Ukraine has requested the extradition (more than two years) no data on his participation in the operation or the desire to participate in it have been reported, never once did the defense side say so," Lysenko concluded.

As it was reported earlier, Ukraine’s Prosecutor General's Office extradited Ingush Timur Tumgoev to the Russian Federation upon the request of the Federal Security Service of Russia.
