According to the law, every person during life can agree for the postmortem organ donation or refuse from it. There is also a possibility to say about your position to the nominee. It is planned to store the information about this in the protected electronic system – United state info system of transplantation.
The law provides the respectful treatment of the body of the person in the case of the postmortem organ donation (the acting law provides that the transplantation of the body materials should not lead to the mutilation of the body).
If a person did not agreement or refusal for the organ donation in life, the relatives of the person would be asked for this. Only after their agreement, the body materials can be transplanted.
If a person refused or his relatives were against the donation, the organs will not be used after the death. The use of the body materials is also forbidden if there is no one to ask for the permission if the court, law enforcers or medical examiner are against it. The veterans of the Anti-Terrorist Operation and Joint Forces Operation, orphans recognized as legally incapable and unidentified people cannot become donor postmortem.
It is planned to create the United state info system of transplantation until October 1. The transplant-coordinator, official of the executive branch responsible for the organ transplantation, medical examiners will be able to browse the confidential information. The register will record who and when was interested in the information of the system as the safety catch.
The Verkhovna Rada of Ukraine adopted the law on transplantation in May 2018. 255 MPs supported it.
