During the debates, judges heard Markiv himself, his lawyer and the lawyer of Ukraine in the civilian lawsuit, Niccolo Bertolini Clerici. He explained that the verdict would make the entire Ukrainian military "criminals against humankind". There are no grounds for such a lawsuit, because Italy has no legal right to judge Ukraine for military crimes; teh case has no signs of a crime againt humankind, and it was not committed on the territory of Italy", Denisova said.
Markiv's lawyer Donatella Rapetti said that the case demands scienfitic expertise, not approximate facts. The lawyer also turned the court's attention to manipulations allowed by the civilian side's lawyer. She also claimed that the verdict of 24 years behind the bars cannot be based on assumptions; one cannot put the person behind the bars if due investigation was not conduted on site.
Vitaliy Markiv is the member of National Guard of Ukraine. Italy accused him of involvement in the murder of Italian photographer Andrea Rocchelli, killed in Donetsk region in 2014. In 2017, the police arrested Markiv in Bologna airport as he came there to visit his mother.
