Law banning animal abuse takes effect in Ukraine

On November 8, the law No. 1684-IX on the prohibition of animal abuse, which was officially promulgated three months ago, has started to act in Ukraine. This is evidenced by the text of the document presented on the website of the Verkhovna Rada.

The Law "On amendments to certain legislative acts of Ukraine (regarding the implementation of the provisions of certain international agreements and EU directives in the sphere of the protection of fauna and flora)" prohibits:

- beat, kill, poison or maim animals, give them as prizes, awards or bonuses;

- begging with animals; provide photography services with wild animals, except for zoos, circuses and dolphinariums;

- to inflict pain, suffering or oppression, to train animals in a way that is harmful to health and general condition;

- to kill animals by drowning, strangulation, use of electric current and substances leading to poisoning;

- leave pets tied if the leash is less than 20 meters, except for dogs that perform guard functions; for such dogs, the length of the leash must be at least 10 meters;

- leave a pet tied up unattended in public places or crowded places (near bus stops, shops);

- tie animals to vehicles and force them to run after motor vehicles;

- to keep in catering establishments, nightclubs, hotels, recreation centers, recreation facilities, large predatory animals, poisonous snakes, birds of prey, other animals posing a threat to humans, animal species listed in the Red Book of Ukraine and Appendix II to Bern Convention on the Conservation of European Wildlife and Natural Habitats.

Moreover, the owner of the animal is obliged to clean up after him traces of vital activities in public places; otherwise he/she will have to pay a fine.

Punishment for cruelty to animals

  1. According to the document, cruelty to animals is mockery of animals, including homeless, resulting in their torment, causing physical pain, suffering, but not causing bodily harm, injury or death, leaving animals without help, as well as other violations of the rules of keeping , handling and transportation provided by law entail the imposition of a fine from two hundred to three hundred non-taxable minimum incomes of citizens (3,400-5,100 hryvnias ($130.47-195.70)) with the confiscation of the animal if its stay with the owner poses a threat to life or health.
  2. Similar actions committed in relation to two or more animals either by a group of persons, or by a person who was subjected to an administrative penalty for the same violation during the year - entail the imposition of a fine from three hundred to five hundred non-taxable minimum incomes of citizens (5,100-8,500 hryvnias ($195.70-326.17)) or administrative arrest for up to 15 days with confiscation of the animal, if its stay with the owner poses a threat to life or health.
  3. Cruelty to vertebrate animals, including homeless animals, violation of the rules for transporting animals, if such actions have led to bodily injury, injury or death of the animal, pitting animals against each other, committed from hooligan or selfish motives, and also propaganda, public calls for the commission of actions that have signs of cruelty to animals, distribution of materials calling for such actions are punishable by restraint of liberty for a term of one to three years or imprisonment for a term of two to three years with confiscation of the animal. The same actions committed in the presence of a minor or underage are punishable by imprisonment for a term of three to five years with the confiscation of the animal.
  4. Similar actions committed with particular cruelty or in relation to two or more animals, or repeatedly, or by a group of persons, or committed in an active way, or violent actions against an animal aimed at satisfying sexual desire, shall be punishable by imprisonment for a term of five to eight years with the confiscation of the animal.
  5. Moreover, all the actions specified above, committed with the aim of creating images, works, film, video, audio products, or the sale or distribution of images, works, film, video, audio products that promote cruelty to animals, are punished imprisonment for a term of five to eight years with confiscation of the animal.
  6. Administrative responsibility for cruel or irresponsible treatment of animals begins from the age of 14, and criminal responsibility - from the age of 16
  7. The law allows for the confiscation of animals in cases of abuse.

On July 15, the Verkhovna Rada adopted a law on the introduction of EU standards in Ukraine concerning humane treatment of animals.

In May, in Kyiv, law enforcement agencies opened criminal proceedings in connection with the fact that a cat and her kittens were thrown out of the window of a high-rise building.

Meanwhile, in Israel, the government was the first in the world to impose a ban on the trade in natural fur in the country.
