President of Ukraine Volodymyr Zelensky registered a bill on illicit enrichment No. 10358 in the Parliament. He proposes to punish top officials who own assets which cost is by $12,142 more than the income of the individual. The respective information is contained in the card of the bill. It is published on Verkhovna Rada website.
The new article on illicit enrichment provides that if an official buys assets which price exceeds his/her income by 20,000 times the minimum non-taxable income of the citizens (by $12,142), he/she will be punished in a form of imprisonment for 5-10 years with deprivation of the right to hold certain posts within three years.
It is proposed to make this provision concern the same circle of officials as the previous version of the law had.
It was stressed that it was about purchase of assets by top-officials or other individuals at his/her expense, with his/her consent of under his/her order.
Assets include cash, money in bank accounts, other property, intangible assets, the amount of reduction of financial obligations.
The income of the person is all the types of incomes he/she gets legally.
The bill also proposes to set an order of recovery of unwarranted assets of top-officials. Anti-Corruption Court will decide on the recognition of the assets as unwarranted. Therefore, the declarations of top-officials will be observed. If there are violations, an individual has ten working days to justify the legitimacy of the property.
If assets are recognized unwarranted, an official will be dismissed.
As it was reported earlier, Constitutional Court recognized the article of the Criminal Code on illicit enrichment of officials unconstitutional.
