Germany's appeal against the court's decision annulling the European Commission's 2016 decision to change the conditions of access to the OPAL pipeline must be rejected

Advocate General recommended that the Court of Justice reject Germany's appeal against the decision to limit Gazprom's use of OPAL gas facilities, as European Truth reports.

"According to Advocate General Manuel Campos Sánchez-Bordona, the principle of energy solidarity can be used to verify the legitimacy of the actions of EU institutions in matters relating to energy. The appeal filed by Germany against the decision of the General Court, which annulled the decision of the European Commission in 2016 to change the conditions of access to the OPAL pipeline, must be rejected," the Court said in a press release outlining the Advocate General's decision.

The opinion of the Advocate General in the Court of Justice is not a final decision, but is usually upheld by the Court. If the European Court of Justice rejects Germany's appeal, it will be a victory for Poland.

Ealier it was reported that Ukraine and Poland called on European Commission to reconsider decision about expanding Gazprom’s access to OPAL gas line. Poroshenko and Duda noted that the EC decision encourages and inspires Russia to continue its strategy of creating problems for obtaining concessions in other areas.
