The defense of ex-president Victor Yanukovych refuses to review case materials in the state treason case, as the pre-trial investigation is not completed yet. This was reported by the press-service of the “Aver Lex” law union referring to the Igor Fedorenko, the lawyer of Yanukovych.
“We haven’t started to familiarize with the case materials according to Article 290 of the Criminal Code of Ukraine and are not going to do this, as the investigation cannot be finished until all the investigative measures, stated in the decision of the chief military prosecutor about prolongation of the investigation term as well as in defense requests, are completed. And until the Russian side completes Ukrainian request due to international legal aid on handing Victor Yanukovych the note of suspicion,” Fedorenko reported.
The press-service reminds that Anatolii Matios, the Chief Military Prosecutor of Ukraine, extended the term of pre-trial investigation in state treason case until March 28, 2017. Thus, as the pre-trial investigation is not over yet, there is no legal basis to review the materials of the case according to the Article 290 of the Criminal Code of Ukraine.
In this connection, the defense filed a complaint to the Pechersk District Court on January 30, 2017.
At the same time, Larysa Sargan, the press-secretary for the Prosecutor General, reported on Facebook: “The defense of ex-president Yanukovych has already started to familiarize with the case materials of the pre-trial investigation in state treason case.”
She also noted that the lawyers have reviewed the first volume.
