The Obolon District Court of Kyiv determined to suspend the state advocate of Viktor Yanukovych Maksym Gerasko from duty in the treason case. The proper decision was made at the today’s court session as 112.ua reported.
One of the reasons for such decision is the fact that Gerasko was not able to review the case papers in time.
‘The court determined to suspend Gerasko due to the nonfulfillment of the imposed duties on the defense of accused Viktor Yanukovych to make the trial take place in the observance of all principles of the criminal proceeding, particularly the fundamental principles of the right for defense and competitiveness’, chief judge Vladyslav Deviatko red out the decision.
The court will also request Kyiv Regional Center of Free Legal Support on the appointment of a new defender for Yanukovych.
The trial will continue tomorrow at 10 am.
Gerasko claimed that the court deprived him of the possibility to properly prepare for the case and defend Yanukovych as 112 Ukraine broadcasted.
‘I fulfilled my professional duties according to the oath of the advocate as the law demands. All my forerunner, including the paid advocates, also fulfilled their duties according to the law however anyone satisfies the court because they want to see the observer. The court and the prosecutor’s office do not want to see the advocate who professionally and legally fulfills the duties. I agree with the attitude of the client that it is not a fair court and it has no perspectives, there is no evidence on the case, this case has no perspectives in the future and any decision will be canceled as far as it is illegal’, Gerasko claimed.
Prosecutor in the trial Ruslan Kravchenko claimed one more time that Yanukovych’s defense did everything to delay the proceeding.
The state advocates were appointed to Yanukovych after the refusal of the participation of the private advocates. Firstly, it was Victor Meshechek but he claimed about the self-disqualification. Maksym Gerasko was appointed after Meshechek and he even came to Russian Rostov-on-Don for the meeting with a client. There were no negotiations between the advocate and the client. Moreover, Gerasko claimed that he had enough time to review the case documents.
Yanukovych is charged with three articles of the Criminal Code of Ukraine: Part 5 of Art. 27 (high treason), Part 2 of Art. 437 (aiding in an aggressive war); Part 3 of Art. 110 (aiding in encroachment on the territorial integrity and inviolability of Ukraine, which resulted in the death of people and other grave consequences).
