Bill #962-IX on the support of culture, tourism and creative industries comes into force in Ukraine.
The proper law implements tax incentives for support of the activity in the sphere of creative industries, culture, tourism, sports and other humanitarian spheres.
Particularly, the law lifts taxes off the profit of enterprises and profit of the physical persons received by payers the targeted assistance provided at expense of the budget funds or funds of the international technical assistance for implementation of projects or programs in the sphere of creative industries.
Lowering the tax rates for value-added for operations on the provision of the services tied with the spheres of culture and tourism, particularly, the services for stage performance, cultural events, excursions at the museums, zoos and reserves and their attendance. Besides, the lowering VAT rate will be applied for showing movies adapted in the Ukrainian-language variants for people with visual impairment and hearing impairment.
According to the document, the tax rate is determined on the basis of taxation in the amount of 7% for the following operations:
- provision of services of showing (holding) theater, opera, ballet, musical, concert, dance, puppet, circus, sound, light and other performances, staging, performances of professional artistic groups, art groups, actors and singers, cinema premieres, cultural and art events;
- provision of services of showing original music, demonstration of show projects, holding of excursions for groups or individual visitors in museums, zoos and reserves, visiting of their territories or objects by guests;
- provision of services on temporary accommodation provided by hotels and similar places for temporary accommodation.
The last group of objects is subject to 7% tax until January 1, 2023.
The operations on import to the customs area of Ukraine in the customs regime of goods that enter the national cinematographic heritage are released from taxation.
Besides, from January 1, 2023, until January 1, 2025, the operations on the provision of the services of showing by demonstrators and distributors of the national films and foreign movies dubbed and scored at the state language in the territory are released from taxation - in case such movies adapted in the Ukrainian-language variants for people with visual and hearing impairment.
The Verkhovna Rada of Ukraine adopted the proper law on November 4, 2020. 239 MPs supported the decision.
