On April 19, 2021, the Supreme Court has started the consideration of the lawsuit filed by TV and Radio Company Novi Komunikatsii (New Communications) on appeal of the order of Ukraine’s President dated February 2, 2021, on the introduction of sanctions against ZiK TV channel.
The hearing of the case was postponed at the request of the Security Service of Ukraine (SBU). The reason for the request was the sending of the documents by the SBU to the court as they make the state secret and which, according to the SBU, were the basis for the introduction of the sanctions.
The same situation occurred during other appeal cases against the order of Ukraine’s President dated February 2, 2021, on the introduction of the sanctions against TV channels. The SBU appealed with the request to extend procedural periods for provision of explanation on the case due to the grounds for the introduction of the sanctions, stating that there is a necessity to fulfill a particular volume of work for the preparation of documents. Consequently, the documents were provided to the court with significant delays and it leads to the delay in the consideration of the cases. The mentioned documents were not made available for representatives of the complainant.
That is why it is still unclear what reasons prevented the SBU from the provision of the documents to the court on the grounding of the appliance of the sanctions if such documents exist and were provided to the National Security and Defense Council and Ukraine’s President for making a decision on sanctions.
Recently, the orders of the President of Ukraine introduced sanctions against a number of persons and entities, including the Ukrainian. As a result of such actions, the activity and normal order of life of people under the sanctions were blocked. The distinctive feature of the orders is strict restrictive measures adopted on the extra curial closed procedure. Meanwhile, particular reasons for sanctions are not reported; quite indistinct the reference to the interests of the national security is provided.
