Ukraine ratifies agreement with Netherlands on joint probe of MH17 crash

Ukrainian parliament adopted a law ratifying an agreement with the Netherlands on cooperation in a probe of crimes connected with the MH17 crash on June 17, 2014. 241 MPs voted in the affirmative.

According to the explanatory note, the agreement regulates the issues on pursuit and conviction in Netherlands of persons for violations connected with the downing of MH17 on June 17, 2014, including the cooperation of the authorized bodies of Ukraine and Netherlands.

Ukraine from its side defined the Prosecutor General's office of Ukraine for inquiries by the bodies pretrial investigation and Ministry of Justice for court inquiries. The Netherlands appointer their Ministry of Justice and Security.

Thus the Netherlands are entitled to pursue those involved in MH17 crash and Ukraine may pass the criminal proceeding to the Netherlands on their request.

The agreement also regulates the issues of transfer of execution of a punishment to Ukraine, including those verdicts made in absentia, the possibility to imply measured to those convicted before the decision on execution of a punishment.
