Customs officers allowed to detain suspects of NABU cases with no decision of court

If an individual gets caught red-handed, he can be detained without the decision of the court

The Ministry of Internal Affairs allowed the officers of the State Border Guard Service to detain the suspects of NABU cases without the decision of the court. Reads the order of the MIA from May 10 registered by the Ministry of Justice on July 18, Ukrainian News report.

It is noted that the order of the Ukrainian MIA approves the new course of actions of the border officers during the detention of suspected of having committed offenses with the decision of the court.

The document allows the representatives of the State Border Guard Service of Ukraine to detain the suspect of the commission of serious or especially serious corruption offense without the decision of the court if there are reasonable grounds to believe that escape is possible to evade criminal responsibility.

Furthermore, if the individual gets caught at the time of the commission of the offense, there is no need in the decision of the court to detain the suspect.

Yet the border officers are imposed to undertake the search of detainees in a separate room with a presence of at least two witnesses of the same sex as the detainee. The search humiliating the human dignity is prohibited.

After the search room, the detainee is being searched for subjects and documents he didn’t have before the start of the search.
