Appeal on prosecution of Servant of the People MP Vasylevska-Smaglyuk for forgery filed to State Investigation Bureau

The MPs of the Verkhovna Rada of Ukraine from Opposition platform – For life appealed to the State Investigation Bureau (SIB) due to the necessity to investigate illegal actions of Ukrainian lawmaker Olga Vasylevska-Smaglyuk and other who initiated creation of the temporary investigative commission (TIC) on liquidation of 112 Ukraine, NewsOne and ZIK TV channels to eliminate the media competitors as the political force reported.

The signs of the criminal offences such as forgery, abuse of power, official position, counteraction legal business activities can be seen in the actions of Servant of the People MP.

The representatives of the opposition political force pointed at the forgery committed during the TIC creation. Vasylevska-Smaglyuk fabricated the draft regulation by provision of false information; she arbitrarily pointed herself as the chairman of the temporary investigative commission and member of the commission without proper submission of the factions with the purpose to head the commission by abuse of her official position along with Ukraine’s MP O. Ustynova she submitted draft regulation #2152 to the Verkhovna Rada for its consideration and adoption.

The systematic analysis of the draft regulation and accompanying documents allows to draw conclusions that the information provided by Vasylevska-Smaglyuk (particularly, the accusation of the TV channels of the involvement in anti-state activity, spread of ideas and theses, which may threat the national security, holding of special information operations aiming for the disruption of the defense capability, demoralization of the personnel of the Armed Forces of Ukraine) is defamatory and knowingly false.

Considering the fact that sanction for the commitment of such crimes for legal persons is their liquidation, it becomes obvious: the decision on the TIC creation toward 112 Ukraine, NewsOne and ZIK TV channels is politically motivated.

The Opposition platform – For life underlined that MP Vasylevska-Smaglyuk did not report about the present conflict of interests and used her official position during the TIC creation. In such actions of Vasylevska-Smaglyuk might contain the signs of the criminal offence tied with the counteraction legal business activities of 112 Ukraine, NewsOne and ZIK TV channels through illegal lobbying of the adoption of this decision by the Verkhovna Rada of Ukraine.

The issue is that Vasylevska-Smaglyuk before the election as the MP of Ukraine was the active participant of the media market (the employee of 1+1 Studio TV Company) and owned the share of the common capital of 1+1 Production, which cost makes $19.592.

“Considering the fact that O. M. Vasylevska-Smaglyuk knew for sure that the ultimate beneficial owner of the mentioned TV channels is MP of Ukraine Taras Kozak who repeatedly and openly confirmed this information and considering her private interests in the media market; there are grounds for the conclusion that the aim for the initiation of the TIC creation by Vasylevska-Smaglyuk is the liquidation of 112 Ukraine, NewsOne and ZIK TV channels to eliminate the media competitors, including by use of the political oppressions and discredit,” Opposition platform – For life noted.

Earlier the regulatory committee of the Verkhovna Rada of Ukraine recommended to the parliament to create the temporary investigation committee (TIC) for investigation of the facts toward the meeting the requirements during the change of the owners of 112 Ukraine, NewsOne, ZIK TV Channels.

On October 17, the Verkhovna Rada of Ukraine has approved as a whole the draft resolution, which provides for the investigation of the activities of three TV channels - NewsOne, 112 Ukraine and ZIK. 278 MPs voted in favor of the decision.
