President of Ukraine Volodymyr Zelensky signed the law "On Amendments to Certain Legislative Acts of Ukraine Concerning the Abolition of Control Marks of Copies of Audiovisual Works, Phonograms, Videograms, Computer Programs, Databases" №1965-IX, the press service of President of Ukraine reports.
It is noted that the document abolishes the obligation to obtain control marks by importers, exporters and reproducers of copies of audiovisual works, phonograms, videograms, computer programs, databases due to the ineffectiveness of the mechanism of "control marking", which leads only to unnecessary costs for legal distributors and is an ineffective procedure for protection against copyright and related rights infringements.
The application of technical means of protection and rights management information to copies of audiovisual works, phonograms, videograms, computer programs, databases, therefore, may not be mandatory, but should be implemented by the subject of copyright and (or) related rights and (or) distributors of relevant products at their discretion with the possibility of choosing any technical methods of implementation, of which there are many today and which are constantly being improved.
At the same time, the subjects of copyright and related rights are given the opportunity to protect their interests and create obstacles to piracy.
In addition, the document recognizes as invalid the Law of Ukraine "On Distribution of Copies of Audiovisual Works, Phonograms, Videograms, Computer Programs, Databases".
The law also decriminalizes the illegal production, forgery, sale of illegally manufactured, obtained or counterfeit control marks for marking the packaging of copies of audiovisual works by removing Art. 216 from the Criminal Code of Ukraine.
