"The bill provides for changing the definition of the subsistence rate, establishing that it is an acceptable level of expenditure that allows maintaining a sufficient standard of living inherent in society. To determine the subsistence level is proposed per person," an explanatory note says.
It is assumed that the subsistence rate should be set as a percentage of the average monthly wage in Ukraine for the year preceding the year of formation of the State Budget of Ukraine for the next year, considering the projected inflation rate of the current year. The percentage of the subsistence rate to the average monthly wage must be at least:
- in 2021 - 40%;
- in 2022 - 41%;
- in 2023 - 42%;
- in 2024 - 43%;
- in 2025 - 44%;
- in 2026 - 45%;
- in 2027 - 46%;
- in 2028 - 47%;
- in 2029 - 48%;
- in 2030 - 49%;
- in 2031 - 50%.
At the same time, if the actual subsistence rate for three months exceeds by more than 10 percent the approved subsistence rate, the Cabinet of Ministers of Ukraine on the basis of monitoring the implementation of the State Budget of Ukraine should consider raising the subsistence rate.
It is also envisaged that the executive body that provides a systematic survey of household expenditures to monitor the dynamics of living standards in Ukraine should conduct a survey of households on actual expenditures on food, non-food products, services, child care and the percentage of savings in the structure of household expenditures. . For the purposes of this Law, a household is a declared economic association of one / two / several persons who keep joint records of income and expenses subject to personal income tax.
For the qualification of administrative offenses defined by this Code, the unit of account established by the law on the State Budget of Ukraine for the relevant year shall be used. The monetary penalty is set in the form of a penalty rate, which is 2% of the unit of account.
