The State Duma of Russian Federation adopted a draft regulating the use of physical force, riot control weapons and firearms to the prisoners in the third and final reading, the law is also known as the “sadist law” according to the website of Dozhd TV channel.
According to the draft, the supervisors can use riot control weapons to stop any custodial control violations, to block the movement of groups of prisoners and other "illegal actions that disrupt the work of the penitentiary facility”. At the same time this bill excludes the concept of "malicious" resistance and disobedience of the prisoner to the Federal Penitentiary Service officer.
The document was introduced by the Government in May 2015, but it only passed the second reading only in December 2016. There were some significant changes in the text; the controversial rule that allowed employees of Federal Penitentiary Service (FPS) to use batons and electric shocker for any violation of the regime was removed. Because of this norm, the lawyers initially called the document the "sadist law".
The draft now also contains the demand to "urgently" call the doctor for the convicted after the use of force, riot control weapons, etc. FPS officers will be required to immediately allow doctors to record all the damages of the convicted.
In case of use of force, riot control weapons or firearms, the officers of the prisons and colonies will have to use if possible, portable video recorders or cameras. The law provides the requirement not to carry out illegal orders of authorities on the use of force and weapons.
The document will take effect after the approval by the Federation Council and after being signed by the President.
