The Profile Investigation Department of the Prosecutor General’s office will continue working after the investigative function is transferred to the State Bureau of Investigation. The Prosecutor General’s office will perform the procedural guidance; Prosecutor General Yuriy Lutsenko claimed this at the operative session having summed up the work over nine months, 112.ua reports.
‘The completion of the investigation function of the Prosecutor’s office is a separate topic that requires our analysis. We hope the State Bureau of Investigation will start working on its first investigations soon. It is hard to believe, to be honest, although the agency's chief insists that it is about to start,’ the Prosecutor General claimed.
‘The Profile Department in the State Bureau of Investigation will conduct procedural guidance of criminal proceedings of the Central Administration of the State Bureau of Investigation,’ he advised.
Currently, the Profile Department of Prosecutor General’s Office provides the guidance in more than 770 criminal proceedings, where 340 people were informed of suspicion.
As we reported earlier, the Ukrainian parliament adopted a law on the observance of the rights of participants in criminal proceedings and other persons during the pre-trial investigation.
The draft law amends several articles of the Criminal Procedure Code of Ukraine, in terms of providing another person whose rights or legitimate interests are limited during the pre-trial investigation, or his representative, the right to file petitions to the investigator. The prosecutor is to close the criminal proceedings if there is an unreasonable decision of the investigator or no criminal offense is detected.
