President Poroshenko signed the law 4128-d “On the subordination of religious organizations and the procedure for state registration of religious organizations with the status of legal entities.” The press service of the President reports.
According to the law, the change of subordination of a religious organization on a general meeting is approved by two-thirds of votes of the present. Those two-thirds are counted from the number of parishioners, required for conducting a general meeting of their religious community. The decision to change subordination and to make appropriate amendments or additions to the statute is affirmed by the signatures of members of the religious community.
The enactment defines the list of documents that have to be submitted for registration of the statute (position) of the religious community. According to the final statutory provisions, the religious organizations inform the Ministry of Culture or the local state administration about the change of subordination, and they publish the information on the official site. The law comes into force in one day after its official publication.
The law does not provide any criteria for people's membership in the religious communities, which leaves room for speculation.
The document also provides for a temporary ban on carrying out any actions with parish property. Thus, upon transferring a parish, it is impossible to sell, take away or pledge its real property. If a part of the parish does not want to conduct a transition into a new church, it can form its own new religious community and has the right to conclude an agreement on the alternate use of the temple.
