The Verkhovna Rada of Ukraine refused to submit for improvement the draft amendment to Basic law #1014 on authorities of the president to create independent regulatory bodies and appoint heads of the National Anti-Corruption Bureau (NABU) and State Investigation Bureau (SIB). 214 MPs supported the decision as 112 Ukraine reported.
According to the proposed amendment of Article 106 of the Constitution, the president creates the NABU and appoints and dismisses the heads of NABU and SIB in the order established by the law.
Moreover, it is offered to provide the leader of the country with the authorities to create independent regulatory bodies, which hold the public regulation, monitoring, and control over the activity on management in particular spheres, appoint and dismiss their members in the order established by the law.
Article 106 of the Constitution contains the list of authorities of the president of Ukraine.
At the same time, the law on NABU provides that the Head of the Bureau is appointed by the president from the candidates selected by the competition commission. The Verkhovna Rada may dismiss the head on the submission of at least 150 MPs with the presence of one of the conditions.
The SIB law provides that the Head of the Bureau is appointed by the president on the submission of the premiere, according to the submission of the competition commission.
The Constitutional Court recognized this bill as unconstitutional.
