Kyiv Appeal Court refuses to satisfy the appeals of the lawyers of Chairman of Political Council of Opposition Platform - For Life Party Viktor Medvedchuk against the extension of the house arrest of the politician until September 7. The proper decision was made today, on July 30.
Thus, the leader of the opposition will stay under house arrest until September 7.
Today, the lawyers of Viktor Medvedchuk stated that as of today, there is no fact that confirms the legality of the decision of the investigative judge of Pechersk district court Serhiy Vovk on the extension of the house arrest. Moreover, the defense filed a number of appeals, particularly, on the possibility for Medvedchuk as MP to admit citizens with further fulfillment of their requests.
Leader of opposition Viktor Medvedchuk, addressing a speech at the court, crucified all accusations of the prosecutors and stated that the SBU employees illegally held investigative actions and falsified the case and evidence on the case against him.
“The arguments that I brought; objectively show that the Security Service of Ukraine had direct, illegal, and criminal relation to my case. They illegally held investigative actions. They illegally, violating the norms of the Criminal Procedure Code of Ukraine, norms of the Constitution, adduced “arguments” and “evidence” that they consider to be acceptable and it directly contradicts the norms of the Criminal Procedure Code that I referred to. It means only one thing, the SBU, holding the investigation from the moment of the registration March 11 until April 26, falsified this case, forged materials that were mentioned in the materials of the suspicion only in 14 days,” the MP stated.
Viktor Medvedchuk noted that the illicit actions of the SBU against the opposition on the orders of the authorities have started in 2019.
“The SBU on the order of President Zelensky and his team has started the illicit, criminal actions against the lawmakers of the factions in 2019. The mass media was massively reported and it still receives reports that all mechanisms of illicit actions from the SBU were engaged to implement the tasks set by the President of Ukraine. The SBU supported by the prosecutor’s office, did everything that fabricated materials of the case and evidence that are unacceptable become the subject matter at the court of the first instance and today it is subject matter at Kyiv Appeal Court. I believe that the criminal activity of the SBU that was aiming for falsification of these materials; is nothing else but the criminal persecution of the opposition and political repressions. It is the way I consider everything that happens today,” Medvedchuk said.
Earlier, lawyer of the opposition politician Larysa Cherednychenko stated that the evidence brought by the prosecution in the case of Chairman of Political Council of Opposition Platform - For Life cannot be put on the basis of the suspicion.
“The evidence that ground suspicions (to Viktor Medvedchuk) were gathered by the unauthorized body. Plentiful judicial practice of Ukraine tells that such evidence cannot be put in the basis of the suspicions but investigative judge Vovk has founded his own judicial practice in accordance to which, somebody collected evidence, regardless of their quality; we put them in the basis of the suspicion and thus, we would ground any decision, including illegal quality of the SBU expert studies. The conclusions of the expert study are not categorical but probable (probably the action was committed by Viktor Medvedchuk, probably his voice, probably his handwriting) but we cannot state it categorically. What does the law tell when the doubt is in favor of the suspect? What does investigative judge Vovk say? There are doubts; but I do not doubt that Medvedchuk committed it, we have grounded suspicions and I extend his restrictive measures,” she noted.
Meanwhile, Cherednychenko added that the defense to dispel all suspicions has appealed with relevant requests to the competent expert establishment that does not depend on the SBU, SIB, or prosecutor and prosecution.
“Independent competent forensic experts provided the conclusions that were directly opposite from the conclusions of the prosecution side. The results of the expert studies state that Viktor Medvedchuk is not involved in the case that he is incriminated with; Viktor Medvedchuk did not commit any illicit actions any attempts to suspect him in the actions that are illegal are the crime in fact,”
On February 2, Volodymyr Zelensky signed a decree on sanctions against 112 Ukraine, NewsONE, and ZiK TV channels. By this decree, he enforced the decision of the National Security and Defense Council on sanctions on the cancellation of the broadcasting licenses of the TV channels belonging to Taras Kozak (112 Ukraine, NewsOne, ZIK). According to the decree that is eligible since the moment of signature, the TV channels faced sanctions that will be active for five years. These sanctions make broadcasting impossible.
On February 26, journalists of the TV channels illegally closed by President Volodymyr Zelensky united and created a new TV channel – Pershiy Nezalezhniy. The founders of the new media are a group of journalists who previously worked on the channels 112 Ukraine, NewsOne, and ZiK. However, only an hour after the start of the broadcast, the authorities illegally disconnected the channel’s broadcasting.
Earlier, on February 19, the National Security and Defense Council imposed sanctions on eight people (three of them Ukrainians), including Viktor Medvedchuk, Chairman of the Opposition Platform for Life Political Council, and his wife, Oksana Marchenko.
On May 13, the Kyiv court chose the restriction measure for Viktor Medvedchuk, the opposition MP and Chairman of the Political Council of Opposition Platform - For Life party. On July 9, the court extended the house arrest of Viktor Medvedchuk until September 7. The lawyers of the politician stated about the recusal of the judge Serhiy Vovk right after the end of the court session. However, the court declined the appeal on recusal of the judge and prosecutor.
Commenting on the situation, Viktor Medvedchuk underlined that his lawyers have enough evidence to refute all ungrounded accusations brought by the prosecutor’s office. We also have enough arguments to fight, considering our legal system, considering current legislation.
