The Ministry of Economic Development, Trade and Agriculture published the text of the draft law "On Amendments to Certain Legislative Acts of Ukraine on the Circulation of Agricultural Lands", which was reported on the Ministry's website.
According to the bill, the subjects of land purchase or land ownership acquisition are:
- citizen of Ukraine;
- territorial communities;
- legal entities of Ukraine;
- foreigners and stateless persons in the case of inheritance and with an obligation to alienate the land within a year.
Acquisition of land by foreigners can be limited by sanctions - they can be applied to states, individuals, legal entities. Sectorial sanctions may also be imposed.
"The Law of Ukraine "On Sanctions" is supplemented by a new type of sanctions "ban on the acquisition of land”. Such sanctions are imposed by the President's decision, based on the National Security and Defense Council of Ukraine submission and approved by the Verkhovna Rada of Ukraine resolution. The sanctions may be applied to the foreign states, unspecified persons within certain sphere of activity (sectorial sanctions) and certain legal entities and individuals," - the message says.
Earlier, Deputy Minister of Economy Taras Vysotskyi ruled out the possibility of land acquisition by Russian residents (as an aggressor country).
The minimum starting price for the sale of state and communal land is set and cannot be lower than its normative monetary valuation.
Restrictions are imposed on the aggregate area of agricultural land that may be owned by the citizen and the legal entity and persons associated with it. Restrictions do not allow the acquisition of more than 15% of agricultural land in the region and 0.5% of agricultural land.
The tenant's right to purchase the plot of land is guaranteed.
The State Registrar is obliged to enter information on the price of property rights, including rights of usage, into the Register of Property Rights.
Citizens can buy plots of land for peasant (farmer) farming, which they own on the right of permanent use and the right of usufruct. It is allowed to purchase them with installments of up to 5 years at a price equal to the normative monetary valuation of such land plots.
On September 2, it was reported that President of Ukraine Volodymyr Zelensky had instructed the Cabinet of Ministers to develop a land market bill by October, and the Verkhovna Rada to approve it, abolish the moratorium on land sales by December of this year.
Yesterday, Zelensky said that according to the market model that is currently being developed by the government, only Ukrainians will be able to buy land in Ukraine.
