Victor Yanukovych’s defense has filed application to cease absentee investigation in his case, as they do not see grounds for it anymore. Such position was declared by lawyer Vitaly Serdiuk on air of 112 Ukraine TV channel.
According to him, the Prosecutor General’s Office of the Russian Federation responded to the request of Ukrainian colleagues about Yanukovych whereabouts and declared its readiness for investigative actions, thus there is no need in absentee investigation anymore.
"I want to clarify that there is no need to conduct special preliminary investigation anymore. According to the Article 297-4 of the Criminal Procedure Code, the investigation in absentia is not necessary if there is no basis for it and the procedure continues as usual. Thus, any familiarization with the case materials is out of questions. The message from the Russian Prosecutor General was received, it confirmed Yanukovych whereabouts, confirmed the possibility of conductions all investigative actions, thus we can not speak about conducting absentee investigation or sending the case to court," lawyer noted.
He also claimed that lawyers have not reviewed the case materials although the deadline for this procedure ends today.
"Today the defense filed the application to cease special investigation of the case, thus we consider that the investigation should get back and be conducted as usual from the date of submission, due to the fact that there is no according basis which used to be the reason for this investigation in absentia," defender said.
