Shevchenkivsky district court of Kyiv granted the motion of the MPs from the Opposition platform – For life concerning the criminal omission of the State Investigation Bureau (SIB). The court obliged the bureau to put the information on the commitment of the criminal offense provided in the statement of MPs Vasyl Nimchenko, Yuriy Zahorodniy and Rinat Kuzmin to the United register of the pretrial investigations as the political force reported.
Thus, on October 16, the representatives of the Opposition Platform – For Life appealed to the SIB with the report that the actions of Servant of the People MP Olga Vasylevska-Smaglyuk contain the signs of the criminal offenses such as forgery, abuse of power or official position, counteraction of the legal business activity.
“MP O. Vasylevska-Smaglyuk and others resorted to such actions initiating the creation of the temporary investigative committee for liquidation of 112 Ukraine, NewsOne and ZIK TV channels to eliminate media competitors,” the message said.
The SIB employees, despite the demands of the Criminal Procedure Code of Ukraine did not put the information on the commitment of the crime on the register, that is why the lawmakers, whose rights as the claimants, were violated, appealed to the court and archived the delivery of the fair and legal court decision, which orders not only to put the information to the register within 24 hours but also to begin the pretrial investigation and provide the document to the claimants which confirm the fact of putting the information on the register.
It is underlined in the appeal of the MPs to the SIB that the analysis of the draft regulation and accompanying documents allow to draw the conclusions that the information provided by Vasylevska-Smaglyuk (particularly, the accusation of the TV channels of the involvement in the anti-state activity, spread of ideas and theses, which may threat the national security interests, holding of special information operations, aiming for the disruption of the defense capability, demoralization of the personnel of the Armed Forces of Ukraine) is defamatory and knowingly false and the decision to create the commission against 112 Ukraine, NewsOne and ZIK TV channels is politically motivated.
The Opposition Platform – For Life underlined that MP Vasylevska-Smaglyuk did not report about the present conflict of interests and used her official position during the TIC creation. In such actions of Vasylevska-Smaglyuk might contain the signs of the criminal offence tied with the counteraction legal business activities of 112 Ukraine, NewsOne and ZIK TV channels through illegal lobbying of the adoption of this decision by the Verkhovna Rada of Ukraine.
“Considering the fact that O. M. Vasylevska-Smaglyuk knew for sure that the ultimate beneficial owner of the mentioned TV channels is MP of Ukraine Taras Kozak who repeatedly and openly confirmed this information and considering her private interests in the media market; there are grounds for the conclusion that the aim for the initiation of the TIC creation by Vasylevska-Smaglyuk is the liquidation of 112 Ukraine, NewsOne and ZIK TV channels to eliminate the media competitors, including by use of the political oppressions and discredit,” Opposition platform – For life noted.
Earlier, the regulatory committee of the Verkhovna Rada of Ukraine recommended to the parliament to create the temporary investigation committee (TIC) for investigation of the facts toward the meeting the requirements during the change of the owners of 112 Ukraine, NewsOne, ZIK TV Channels.
On October 17, the Verkhovna Rada of Ukraine has approved as a whole the draft resolution, which provides for the investigation of the activities of three TV channels - NewsOne, 112 Ukraine and ZIK. 278 MPs voted in favor of the decision.
