Solomensky district court of Kyiv obliged the National Anti-Corruption Bureau of Ukraine (NABU) to open the criminal proceeding toward possible abuse of power or official position by Prosecutor General of Ukraine Yury Lutsenko as the court reported.
Thus, on October 13, 2018, a claimant appealed to Chairman of the Verkhovna Rada Andriy Parubiy on the commitment of the criminal offense such as abuse of power or official position by Prosecutor General Lutsenko.
“On February 1, 2019, the mentioned appeal was sent to the NABU from the Verkhovna Rada Committee on Prevention and Counteraction Corruption. However, the information on the committed criminal offence was not put in the United register of pretrial investigation,” the materials of the case stated.
A claimant asked to abolish the decision of the NABU director on the refusal to execute the demands of the Criminal Procedure Code of Ukraine during the receiving of the application/report on the criminal offense and oblige the NABU director to put the mentioned information in the United register of pretrial investigation.
Neither claimant nor NABU representative came to the court session on this case. On August 5, a claimant filed the appeal in which he supported the arguments set out in the complaint and asked to consider the appeal in his absence. The judge granted a request. In his turn, the NABU representative filed his written objections against this complaint.
Finally, the judge decided to grant the claimant’s motion against the inaction of the NABU Head partially.
“To oblige the official of the NABU, whose competence includes putting of the data in the United register of pretrial investigation no later than 24 hours after receiving of the copy of the regulation to put the information on the criminal proceedings mentioned in the appeal in the United register of pretrial investigation”.
The decision of the court cannot be appealed.
In March 2019, the State Investigation Bureau launched the criminal proceeding against the General Prosecutor Yuriy Lutsenko on possible disclosing of the information about the investigation of the murder of activist Kateryna Hanzdiuk.
