Today, on October 12, Naftogaz of Ukraine and Kyyivteploenerho made an agreement on gas supply, which is based on the settlement agreement adopted in Kyiv Economic Court on Wednesday, reports the press office of Naftogaz.
The agreement concluded on the conditions provided by the decree of the Cabinet of Ministers of Ukraine of 22.03.2017 about imposing special obligations on the subjects of the natural gas market to ensure public interests in the operation of the natural gas market.
It means that Kyyivteploenerho will receive gas on preferential terms set by the Government for the heat producers, which provide people and other protected customers with heat energy.
Along with the signing the agreement, Naftogaz provided Kyyivteploenerho with nominations for the middle of October. Consequently, Kyyivteploenerho is able to restore hot water supply in Kyiv and timely start a heating season.
‘As well as Kievans, we hope that hot water supply will be quickly restored in the capital. The agreement with Kyyivteploenerho is concluded on the conditions defined by the legislation. We made the offer to the company yet in spring. We hope that if there is a change of the manager of a heat supply enterprise in other cities, then all necessary measures will be taken not to cause inconvenience to customers. All contentious issues between the companies have to be resolved in time and only within a legal framework,’ Serhii Pereloma, Principal Deputy Chairman of Naftogaz claimed this.
According to the settlement agreement, Kyyivteploenerho becomes the legal successor of all contracts of Kyivenergo with Naftogaz and debt obligations for $86 million.
The sides agreed that issue of penalties, in respect of which the trials had not yet been completed, are not subject to the regulation of the settlement agreement and will be decided separately in court.
