Law on children protection from sexual abuse comes into force

The law “On children protection from sexual abuse and sexual exploitation” amending Criminal Code of Ukraine came into force on April 18 on the day of its official publication.

This law criminalizes sexual relations between adults and persons who have not reached the age of 16. This way, the age of sexual maturity is set (earlier it has been established through the examination).

Thus, adults who have natural and unnatural sexual relations with a person under the age of 16 is punishable by imprisonment of up to 5 years. If a close relative commits this crime to minor, he/she could be imprisoned for a term of up to 8 years with the loss of the right to hold certain posts or engage in certain activities for up to 3 years.

The establishment and keeping of places of sexual abuse and pandering to sexual abuse involving a minor will be punished by imprisonment for 5 to 10 years.

As it was reported earlier, the President of Ukraine, Petro Poroshenko signed the law on amendments to the Criminal Code on the protection of children from sexual exploitation.

According to the changes, voluntary sexual relationship with a person under the age of 16 committed by an adult is criminalized. Thus, the minimum age of sexual adulthood is established, which is in line with the recommendations of the UN Committee on the Rights of the Child.

Only an adult will be responsible for the sexual relationship with a teenager aged less than 16. It will not concern sexual relationship with mutual consent when both sides are underage.
