Bank accounts of only Ukraine’s alcohol producer, which supplies raw materials for domestic vodka, are arrested in connection with the claims of the State Fiscal Service about the debt of the enterprise. "Ukrspyrt" has already announced that it is forced to stop shipments to vodka makers.
"Ukrspyrt" state enterprise, which is a monopolist in the production of edible alcohol in Ukraine, reported the arrest of accounts in connection with "uncoordinated tax accruals of 2012-2014." The acting head of "Ukrspyrt" Yuriy Luchechko, told 112.ua that the notice of the arrest of the accounts was received on Tuesday, May 29. After that, the Prosecution General applied to the Kyiv District Administrative Court, forwarded relevant appeals to the Cabinet. But the decision has not been canceled so far.
The case, related to the arrest of the accounts, comes from 2016: the State Fiscal Service requires payment of USD 7,8 million. "Ukrspyrt" does not agree with this sum, and, according to Luchechko, the entity has a package of documents confirming that there are no grounds for calculating the number of penalties.
The press service of the State Fiscal Service reported 112.ua that the decision to apply financial sanctions amounting to USD 7 million was taken as early as in 2014 in connection with the violation of part 2 of Art. 17 of the Law of Ukraine "On state regulation of production and turnover of ethyl alcohol, cognac and fruit, alcoholic beverages and tobacco products." Namely: selling alcohol products without a representative of the State Tax Service. "The enterprise did not comply with the decision of the tax authority, and “Ukrspyrt” filed a lawsuit with the court to invalidate the decision on the application of financial sanctions. The courts of the first and appellate instances upheld the decision of the tax authority. In 2015, the courts of the first and appellate instances decided to recover USD 7 million from the state enterprise "Ukrspyrt." For the execution of the decision, the executive letter was sent to the State Executive Service of Ukraine, which opened the enforcement proceedings and seized the money. As the Supreme Administrative Court sent a new decision to invalidate decisions on the imposition of penalties, the Prosecution General applied to the court for recognition of the writ of the executive letter, and Supreme Court of Ukraine in 2018 concluded that the writ of the executive letter is lawful and enforceable. In such circumstances, the actions of the State Fiscal Service are limited to the available decisions of the courts, which are mandatory on the territory of Ukraine," the press service of the State Fiscal Service told 112.ua.
Acting head Yuriy Luchechko said that in connection with the arrest of accounts, distilleries in the near future can stop the shipment of alcohol to the producers of vodka. "We still have grain reserves, from which we can produce alcohol, but they are minimal, we cannot buy new grain, nor can we pay for gas supplies," Luchechko said. At the same time, "Ukrspyrt" is the only country’s alcohol supplier for domestic distilleries.
Vodka producers should transfer the advance money for the production of new volumes of alcohol to the Prosecution General, but these funds are likely to go for paying the penalties.
