SAP vs. NABU is like a Santa Barbara soap opera: fights, radically different versions, a car accident, and conflict of competence

The Specialized Anti-Corruption Prosecutor's Office (SAP) and the National Anti-Corruption Bureau (NABU), or, rather, their leaders, have been in conflict for a long time. The first series of the conflict occurred in March. The second, on September, 19th. Both were extremely epic. But first things first.

Previously on “SAP vs. NABU”

In the office of the head of SAP Nazar Kholodnytsky, an audio surveillance was found (on the aquarium).

Later it turned out that Kholodnytsky’s affairs were being investigated by the NABU employees (in particular, they talked about the possible incitement of witnesses to give false testimony, about disclosure of information of pre-trial investigation to persons who are not related to the relevant criminal proceedings).

The head of the NABU has initially denied the fact of audio surveillance, but when asked for how long these devices have been there, he said that for about a month. The media were actively reporting about Kholodnytsky’s resignation, but it did not take place. At the end of August, it became known that the case against the head of SAP (concerning bribery), on the basis of which he was auditioned by NABU, was closed. Kholodnytsky has walked away with an admonition. NABU decided to challenge such an “easy” form of punishment in the Supreme Court.

Episode 2

The conflict escalated on September 19. The scene is close to the SAP building.

SAP says that the employees of the DSP found in the yard of the building a bus with the employees of the NABU, who allegedly were running wires for audio surveillance. SAP decided that they were going to bug them.

Employees of SAP have called the police, and they have blocked the bus. Special Forces of the NABU were called for deblocking those blocked. During this procedure, a fight broke out. The Special Forces have pulled Kholodnytsky’s driver out of the car (later the head of the SAP said that the driver had been beaten) and drove the car away and provoked a car accident.

Representatives of the Security Service (SBU) came for the investigative actions. At this time the Special Forces had already left the stage.

Nazar Kholodnytsky was the first to follow the results of the incident. His theses:

- An illegal wiretapping and a bus with employees of the NABU have been detected.

"When the police arrived, suddenly the NABU Special Forces came in. The SAP driver was pulled out of the company car by the force and a NABU worker took his place, and, as far as I understand it, deliberately led a minibus on workers, as I understand it, the DSP workers, and on all people. There was an accident involving Pajero and two other cars. Now, the law enforcers are registering the accident."

-He will insist on a qualitative investigation.

"I will insist and I will ask the leadership of the SBU and the police to conduct a qualitative investigation of each of these factories - on the fact of wiretapping, deliberate road accident, car hijacking, which was recorded on video, on the fact of illegal actions of each member of the special forces of NABU that were involved in this operation."

"In order to save employees from exposure, from revealing illegal and unregistered means of collecting information. Artem Sytnyk used the force unit of NABU, which had firearms and used violence against the law enforcement officers, damaged property of the citizens, and prevented the conduct of the investigative actions"

Artem Sytnyk and his theses:

Employees of NABU conducted "investigative actions" in that area.

"I can not disclose them completely (investigative actions, - Ed.), because this is the secret of the pre-trial investigation."

He did not understand the reasons for the blocking of the bus.

"Our special operations officers were riding, they were blocked by the cars of the Specialized Anti-corruption Prosecutor's Office. The reasons for this blockage were not explained, and then our employees took measures to remove this blockage and go ahead to carry out their official duties."

NABU statement:

"Information about attempts to install equipment to listen to the office of the SAP head is not true.

In response to the statements of Nazar Kholodnytsky, we inform that the employees of NABU did not conduct any actions on the territory of the Anticorruption Prosecutor's Office and in its yard. But in the territory of the children’s hospital, there were legal and sanctioned events in accordance with the current legislation, the essence of which cannot be disclosed yet."

What is next?

It seems that the second “episode” is not the last one. There were no detentions following the results of this series, but SAP opened a number of criminal cases. At the same time, NABU continues to seek a more severe punishment to Kholodnitsky on the basis of the wiretapping. The conflict continues.
